Annexe 1 | Withdrawal form

1. General withdrawal conditions

1.1. The Buyer acknowledges that it is not possible to withdraw from, inter alia, a purchase agreement for the supply of goods that have been modified according to the Buyer's wishes or their person, from a purchase agreement for the supply of perishable goods, as well as goods that have been irretrievably mixed with other goods after delivery, from an agreement for the supply of goods in closed packaging which the consumer has removed from the packaging and which cannot be returned for hygienic reasons, and from an agreement for the supply of a sound or visual recording or a computer programme if the original packaging has been damaged.

1.2 Unless the case referred to in Article 1.1 or any other case that the purchase agreement cannot be withdrawn from, the Buyer has the right to withdraw from the purchase agreement within fourteen (14) days of receiving the goods, provided that if the subject of the purchase agreement is several types of goods or the delivery of several parts, this period will run from the date of receiving the last goods delivery. Withdrawal from the purchase agreement must be sent to the Seller within the period specified in the preceding sentence. The Buyer may withdraw from the Purchase agreement using the model form provided by the Seller, which is attached to the Terms and Conditions. The Buyer may send the withdrawal from the Purchase agreement, inter alia, to the Seller's business address or the Seller's e-mail address info@irisimo.com

1.3 In the event of withdrawal from the Purchase agreement pursuant to Article 2.2, the Purchase agreement shall be cancelled from the outset. The Goods must be returned by the Buyer to the Seller within fourteen (14) days of the Seller's receiving the Purchase agreement withdrawal. If the Buyer withdraws from the Purchase agreement, the Buyer shall bear the costs of returning the goods to the Seller, even if the goods cannot be returned by the usual postal means due to their nature.

1.4 In the event of a Purchase agreement withdrawal pursuant to Article 2.2, the Seller shall return any money received from the Buyer within fourteen (14) days of the Buyer's Purchase agreement withdrawal in the same manner that the Seller received it from the Buyer. The Seller is also be entitled to return the performance already provided by the Buyer upon the Buyer returning or otherwise, provided that the Buyer agrees to this and no further costs are incurred by the Buyer. If the Buyer withdraws from the purchase agreement, the Seller is not obliged to return the monies received to the Buyer before the Buyer returns the goods to the Seller or proves that he has sent the goods to the Seller.

1.5 The Seller shall be entitled to unilaterally offset the claim for payment for damage to the goods against the Buyer's claim for reimbursement of the purchase price.

1.6 In cases where the Buyer has the right to withdraw from the Purchase agreement in accordance with the provision under Article 1.2, the Seller is also entitled to withdraw from the Purchase agreement at any time up to the time the Buyer accepts the goods. In such a case, the Seller refunds the Buyer with the Purchase Price without undue delay, in cash to the Buyer’s designated account.

1.7 If a gift is provided to the Buyer together with the Goods, the gift agreement between the Seller and the Buyer is concluded with the condition that if the Buyer withdraws from the Purchase agreement, the gift agreement will also cease to be effective and the Buyer is then obliged to return the gift provided together with the Goods to the Seller.

2. Withdrawal from the agreement in excess of the law

2.1 Except as provided in Clauses 1.1 and 1.2, the Seller allows the Buyer to withdraw within twelve (12) months of purchasing the Goods. The Buyer shall be entitled to request that the Seller replaces the Goods within the same period. The right under paragraph 2.1. will cease in cases under paragraph 1.1. and further if the goods have been used, worn, show signs of wear and tear or do not contain the complete set of accessories supplied with them (especially the box, warranty card, etc.).
